2. Data Protection Responsibility
The owner is responsible for the personal data collected by browsing and using this Site in accordance with the requirements of Regulation (EU) 2016/679 (GDPR), Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE) and Spanish Organic Law 3/2018 (LOPDGDD). By using this Site you are deemed to have read and understood the information provided regarding the processing of your personal data.
3. Data Protection Policy
We apply the principle of proactive accountability and continuous improvement of the data-protection system to ensure: (i) respect for fundamental rights and freedoms; (ii) lawful, fair and transparent processing; (iii) accuracy, adequacy, relevance and data minimisation; (iv) explicit and legitimate purposes; and (v) integrity and confidentiality.
The purpose of this document is to inform users about what we do with their personal data, how it is collected, for what purposes it is used, the rights available to them and all the legal information required by the applicable regulations.
4. Data Collected, Purposes and Lawfulness
The personal data processed are those provided by users through the forms available on this Site and are the minimum necessary in order to:
- handle enquiries and information requests;
- manage the contracting and provision of professional services (inheritance, donations, non-resident taxation, Form 210, international successions and similar engagements), including quotes, invoicing, case follow-up and any other task arising from the engagement;
- comply with applicable legal obligations (tax, accounting, registry).
The above purposes are based on the following legal grounds: performance of a contract or pre-contractual steps (Art. 6.1.b GDPR); compliance with legal obligations (Art. 6.1.c GDPR); legitimate interest (Art. 6.1.f GDPR); and the user's consent (Art. 6.1.a GDPR).
5. Web Forms
Personal data collected through the web form are used to handle the enquiry, carry out a preliminary service-fit review and, where appropriate, prepare a proposal setting out scope and fees. Submitting the form does not by itself create a professional engagement.
For Form 210 or non-resident tax enquiries, the form may request the country of tax residence, number of properties and taxpayers, the property's general situation, urgency and the status of any power for AEAT notifications. Tax-document copies and bank details are not requested at this initial stage.
Data entered into the tax calculators are used solely to perform the simulation requested by the user and are not stored or used for other purposes, unless otherwise indicated and consent is requested.
The processing is lawful on the basis of the consent you give by expressly accepting the conditions of processing set out in this Privacy Policy.
6. Personal Data Processed
The data we may process include, among others:
- identification data: name, surname, NIF/NIE;
- contact details: postal address, email address, phone number;
- preliminary service-qualification data: country of tax residence, number of properties and taxpayers, general property use, urgency or deadline and status of the AEAT power;
- economic and financial data: bank details (for billing), asset information relevant to the requested services (cadastral value, taxable bases, etc., when calculators are used or services are contracted);
- connection and navigation data: IP address, browser type, pages visited (see Cookie Policy);
- other data that the user voluntarily provides in their communications.
7. Data Recipients
Personal data obtained through the web forms are recorded and stored on electronic media controlled and supervised by the controller.
Your personal data will not be disclosed to third parties except where such disclosure is required by law (e.g., to the Tax Agency, Courts and Tribunals) or where, for the proper provision of the service or performance of the contract, it is necessary to communicate your data to third parties, for example:
- Formspree, Inc., the contact-form provider and data processor. Data submitted through the form may be hosted and processed in the United States. Formspree states that it relies on the European Commission Standard Contractual Clauses as a safeguard for these transfers. Information: formspree.io/security.
- Service providers acting as data processors (for example, web hosting or technical-support providers), where their involvement is necessary and the corresponding Article 28 GDPR data-processing agreement is in place.
Use of Formspree may involve an international transfer to the United States, safeguarded according to the provider by the European Commission Standard Contractual Clauses. The controller will verify and maintain the safeguards and data-processing agreement required by the GDPR.
Where disclosure to third parties is not covered by the legal bases above, data will only be disclosed to other recipients if the user has given explicit consent.
8. Technical and Organisational Measures
We implement measures that ensure confidentiality and preservation of data. Personal data collected from the Site are processed over HTTPS with a valid SSL certificate. Staff involved in processing operations are trained and committed to this policy.
9. Data Retention
Contact: data are kept for the time necessary to handle the request.
Service engagements: data are kept while the contractual or commercial relationship exists; thereafter, information will be kept blocked for the legal limitation periods (generally 5-6 years for tax and commercial regulations).
The website does not currently offer a marketing-communications subscription. If one is added in the future, its purpose, legal basis and retention period will be explained in advance and consent will be requested where required.

The contact form does not subscribe you to advertising. If consent-based marketing communications are enabled in the future, that consent may be withdrawn at any time by emailing info@gestisyd.es.

The user may at any time exercise their rights of access, rectification, erasure ("right to be forgotten"), restriction of processing, data portability and objection, as well as the right not to be subject to automated individual decision-making and to withdraw consent previously given.

This website is not directed at minors under 14 years of age. If we discover that we have inadvertently obtained personal information from a minor, we will delete it as soon as possible. If you are under that age, you need the consent of your parents or guardians to provide us with your data.
